Terms of Service
Last updated 2026-09-12. These terms govern use of the Qinci app ("Qinci", "we") by a Shopify merchant that installs it ("you", "the merchant"). By installing Qinci or clicking to approve its charges, you agree to them. See also the Privacy Policy and Data Processing Agreement, which govern how personal data is handled and are incorporated by reference.
1. The service
Qinci reads the ingredient list of products in your Shopify store and, based on a fixed rule set over a curated ingredient database, recommends a complementary product to shoppers. It is deterministic software, not a medical device, and does not provide medical, dermatological or cosmetic-safety advice. Recommendations are only as accurate as the ingredient data available to the engine, sourced from your product metafields, descriptions, a CSV you provide, or a built-in reference table; you are responsible for reviewing that data before relying on it or enabling the storefront widget.
2. Eligibility and your account
You must be an authorised representative of the Shopify store installing Qinci, with authority to bind that store to these terms and to Shopify's own Partner Program Agreement and Acceptable Use Policy, which apply in addition to these terms. You are responsible for the accuracy of the information you provide and for activity on your store's connection to Qinci.
3. Plans and billing
Qinci offers a Free plan and paid Starter / Pro plans, billed monthly through Shopify's own billing system under your Shopify account. There is no separate free-trial period on the paid plans: the Free plan is how you try Qinci before paying, and choosing Starter or Pro starts a paid subscription straight away, at the price shown in the app at the time. You can upgrade, downgrade or cancel at any time from the app or your Shopify admin's app-billing settings; charges already billed by Shopify are handled under Shopify's own refund policy, not ours. Uninstalling the app cancels the subscription.
4. Acceptable use
- Do not attempt to reverse engineer, decompile, scrape at scale, or circumvent rate limits or usage caps on the app or its public endpoints.
- Do not use Qinci to process data you are not lawfully entitled to process, or in a way that infringes a third party's rights.
- Do not resell, sublicense or white-label the service without our prior written agreement.
- Do not use the app in a manner that could disable, overburden or impair it for other merchants.
5. Intellectual property
Qinci, its underlying software, the ingredient database and its rule engine remain our property (or that of our licensors). Nothing in these terms transfers ownership of that software to you. You retain all rights to your own store data; installing the app grants us only the licence needed to provide the service, as described in the Privacy Policy.
6. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee any particular sales, conversion or revenue outcome from using Qinci, that recommendations will suit every shopper, or that the service will be uninterrupted or error-free.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or revenue, arising from your use of Qinci. Our total liability for any claim arising out of these terms or the service is limited to the amount you paid us in the three months preceding the claim. Nothing in these terms limits liability that cannot be excluded under applicable law, such as liability for death, personal injury, or fraud.
8. Service changes and availability
We may change, add to or remove features, and may suspend the service for maintenance, without that being a breach of these terms. Material changes that reduce paid-plan functionality will be announced in the in-app changelog. We aim for high availability but do not guarantee any specific uptime.
9. Termination
You may stop using Qinci at any time by uninstalling it from your Shopify admin. We may suspend or terminate access for a breach of these terms, non-payment, or where required by Shopify or applicable law, with notice where reasonably practicable. Sections 5 through 7 survive termination.
10. Changes to these terms
We may update these terms from time to time; the “Last updated” date above reflects the current version. Continued use of Qinci after a change takes effect constitutes acceptance of the updated terms. Material changes will be flagged in the in-app changelog.
11. Governing law
These terms are governed by German law, without regard to its conflict-of-laws rules, and without prejudice to any mandatory consumer-protection rules of your own country that may apply. Istvan Ekes, trading as Qavlar.tech is the operator; see the legal notice for full identifying details.
